General terms and conditions of business

1. Scope

The following General Terms and Conditions apply to the online shop www.globalpiping.online. The online shop is operated by Ronald Bromhead, Manhorner Str. 39, 29303, Lohheide (hereinafter referred to as the seller). Digital products (e.g., videos) are offered for download by the customer (hereinafter referred to as the buyer). Sales are made exclusively to end consumers.

2. Conclusion of Contract, Storage of Contractual Terms and Conditions, and Contractual Language

(1) By ordering products or services, the customer submits an offer to conclude a contract. The customer selects the desired products or services and enters the data requested during the ordering process. Before submitting the order, the buyer has another opportunity to review and correct all order data. By submitting the order, the buyer submits a binding offer to conclude a contract.

A legally binding contract is only concluded upon acceptance by the seller by

- sending an order confirmation by mail, fax, or email, or

- requesting payment

within 7 days.

(2) The seller saves the order data/registration data and these General Terms and Conditions. The buyer can print or save the contract terms using the options available in the internet browser used.

The order data/registration data are displayed to the customer as an overview during the ordering process.

(3) The contract language is German.

3. Creating a Customer Account

The buyer can create a customer account to optimally use the online service. The buyer is responsible for keeping their access data confidential and for immediately notifying the buyer in the event of loss or misuse by third parties.

4. Payment

The services offered in the online shop are subject to prepayment; payment is due immediately after conclusion of the contract.

5. Consumer Right of Withdrawal

According to section 356 Paragraph 5 of the German Civil Code (BGB), the buyers right of withdrawal expires for contracts for the provision of digital content if the buyer:

- has expressly consented to the entrepreneur commencing performance of the contract before the expiry of the withdrawal period, and

- has confirmed their knowledge that their consent will result in the loss of their right of withdrawal upon commencement of performance of the contract,

and the seller has provided the buyer with a confirmation in accordance with Section 312f of the German Civil Code (BGB).

6. Rights of Use

All content and products of the online shop are protected by copyright. The download products may only be used for private purposes. They may not be distributed, presented, made publicly available, or otherwise publicly reproduced.

7. Claims for Defects (Warranty)

The statutory warranty provisions apply to the seller’s warranty obligations to the buyer.

8. Exclusions and Limitations of Liability

The following applies to the seller’s liability for damages:

(1) The seller is liable to the buyer in cases of intent and gross negligence in accordance with the statutory provisions. The same applies to damages caused by the buyer’s negligence resulting from injury to life, limb, or health.

(2) The seller is only liable for property damage and financial losses caused by negligence if the buyer has breached essential contractual obligations. Essential contractual obligations are those that make proper performance of the contract possible in the first place and on whose compliance the contracting parties may rely.

(3) Liability beyond paragraphs (1) and (2) is excluded.

(4) The provisions in paragraphs (1) to (3) also apply to the seller’s vicarious agents.

(5) Any liability arising from the assumption of a guarantee or pursuant to the Product Liability Act remains exempt from limitations or exclusions in paragraphs (1) to (4).

9. Choice of Law, Place of Jurisdiction

(1) The law of the Federal Republic of Germany shall apply exclusively. The application of the UN Convention on Contracts for the International Sale of Goods is excluded, unless this restricts mandatory legal provisions of the state in which the customer has his or her domicile or habitual residence.

(2) The place of jurisdiction shall be the registered office of our company.
